What does a title company actually do before my closing?
Most of the work happens long before you see a settlement statement. We search the public record back through the chain of ownership for anything that could cloud your right to the property: unreleased liens, unpaid taxes, judgments against a previous owner, easements, boundary discrepancies, or an estate that was never properly administered. Whatever turns up has to be cured before the file can close. That search is why title insurance exists, and it is why a clean closing rarely feels dramatic.
What is the difference between an owner policy and a lender policy?
The lender policy protects the lender’s security interest for the amount of the loan and shrinks as that loan is paid down. It protects them, not you. The owner policy protects your equity for as long as you or your heirs hold an interest in the property, and it does not decrease. In Texas the seller customarily pays for the owner policy and the buyer for the lender policy, but that is custom rather than law and it is negotiable in the contract.
Are title insurance rates the same at every company in Texas?
Yes. Texas is a promulgated-rate state, so the premium for a given policy amount is set by the Texas Department of Insurance and is identical whichever underwriter or agent you use. What differs between companies is the escrow and closing fees, how fast the commitment is issued, whether curative work starts the day a problem is found or the week before closing, and whether you can reach a person who actually knows your file.
Who chooses the title company in a Texas transaction?
Whoever pays for the owner policy has the strongest say, which in most Rio Grande Valley contracts means the seller. In practice the choice is often written into the contract or suggested by an agent. It is worth knowing you are entitled to ask for a different one, and that because the premium is fixed by the state you are never choosing on price. You are choosing on how the file will be handled.
What delays a closing, and how do you prevent it?
The usual culprits are a lien nobody knew about, an heirship problem where a deceased owner’s estate was never administered, a survey that does not match the legal description, a missing release on a loan that was paid off years ago, and lender conditions arriving late. Every one of them takes time to cure, and time is exactly what a contract deadline does not give you. We open the search immediately and raise problems while there is still room to solve them. Do you handle commercial and new-construction closings?
Yes. Commercial files carry entity documents, resolutions, assignments of leases and rents and often several lienholders, and they need someone who has handled them before. Builder and new-construction closings run to a different rhythm again, with mechanic’s lien releases, affidavits of completion and a schedule that has to hold across many units at once.
